Late or missed Dutch VAT returns
Found out that your company should have been registered for Dutch VAT for some time, or missed a few returns? The Netherlands has fixed rules for penalties and interest, and correcting it yourself makes a real difference.
We bring your Dutch VAT up to date
Registration where needed, then every missed quarter filed at a fixed fee. After that, the monthly package applies.
Late returns and late payment
- Return filed late: a penalty of € 82, or € 165 in exceptional cases, for example if you are late every time. A return filed within seven days after the deadline normally gets no penalty
- VAT paid late: a penalty of 3% of the amount, at least € 50 and at most € 6,709. Paid within seven days after the deadline, and the previous period was paid on time? Then no penalty
- The deadline for both is one month after the quarter, or two months for a business without an establishment or permanent establishment in the Netherlands
Which deadline applies? For a company without an establishment or fixed establishment in the Netherlands, the Dutch tax authorities give two months instead of one: the return and the payment must be received by the last day of the second month after the quarter, for example 30 November 2026 for the third quarter of 2026. Filing and paying are separate: a return filed on time with the VAT paid late can still lead to a payment penalty.
VAT that was never declared
If your company owed Dutch VAT but did not declare it, for example because it never registered, the Dutch tax authorities can still collect it by a back-assessment, up to five years after the end of the calendar year in which the VAT became due.
On top of that it can impose a penalty: as a rule 10% of the unpaid VAT, at most € 6,709 per calendar year, and 25% or 50% if it can show gross negligence or intent.
Tax interest of 6.5% a year runs from 1 January after the year concerned until 14 days after the date of the assessment. It is not charged if you pay or disclose the amount within three months after the end of that year.
Correcting it yourself: as a rule no penalty
If you correct it voluntarily, before you know or should reasonably suspect that the Dutch tax authorities are aware of it, the Dutch tax authorities as a rule impose no penalty. Once a tax audit has been announced, it is too late. The VAT and any tax interest remain due.
A correction of € 1,000 or less can be included in your next return. Above that we file a separate correction return.
Example
A company in the United Kingdom has been selling from a Dutch warehouse to Dutch consumers since January 2025, and finds out in October 2026 that it should have registered. The Dutch VAT due is € 2,000 per quarter: € 12,000 for the six quarters up to and including June 2026.
- It registers and files the six missed returns before the Dutch tax authorities contact it: as a rule, no penalty
- Tax interest on the € 8,000 for 2025: 6.5% from 1 January 2026, about € 520 if the assessment is dated mid-December 2026
- No interest on the € 4,000 for 2026, if it is paid before the end of March 2027
- Had the Dutch tax authorities found it first, a penalty of 10% of the unpaid VAT could have followed: € 800 for 2025 and € 400 for 2026
This is a worked example with rounded amounts, not a client case.
What happens when a return is missing
The Dutch tax authorities check on a set date whether the return and the payment have come in. What follows depends on what is missing:
- Return filed on time, VAT not paid: an additional assessment for the VAT you declared, and a payment penalty
- No return and no payment: an additional assessment for an estimated amount, a filing penalty and a payment penalty. You then have to prove that the estimate is wrong
- Payment received before the date of the assessment: the assessment is cancelled automatically. The payment penalty remains, unless you paid within seven days and paid the previous period on time
Is there no return available for a period? Then you must ask the Dutch tax authorities for one within one month after that period. Not asking can itself lead to a penalty.
Example: part of the VAT paid late
A company owes € 12,000 Dutch VAT for a quarter and paid the previous quarter on time. It pays:
- € 4,000 on time
- € 4,000 within seven days after the deadline
- € 4,000 two weeks after the deadline
The payment penalty is 3% of everything paid after the deadline, so also of the part paid within the seven days: 3% of € 8,000 is € 240. Had it paid the full € 8,000 within the seven days, there would have been no penalty. This is a worked example with rounded amounts, not a client case.
Time limits and objections
- A penalty for a late return can only be imposed within one year after the end of the filing term
- A payment penalty, and a penalty for VAT declared too low, can be imposed up to five years after the end of the calendar year in which the VAT became due
- You can object to a penalty within six weeks. A late objection to a penalty can still be admissible if the delay cannot be blamed on you or your adviser
- If the VAT is reduced later, the penalty goes down in proportion
A notice of objection costs € 275. See also Dutch late-filing and late-payment penalties and a Dutch tax authorities letter explained in English.
When no penalty is due
- Absence of all fault: no penalty, or the penalty is cancelled. A court accepted this, for example, when a late payment was entirely the bank's fault
- An arguable position: if your VAT treatment was legally defensible when you filed, no penalty follows, even if it later proves wrong
- Voluntary correction before you know or should suspect that the Dutch tax authorities are aware of it: as a rule no penalty
For a penalty for gross negligence or intent, the Dutch tax authorities must first tell you that they intend to impose one, and give you the chance to respond. If neither you nor your adviser understands Dutch well enough, it provides a translation in a language you understand, usually English, German or French.
Unable to pay at once?
Payment problems never give extra time to file, so always file on time, also when you cannot pay yet. A payment arrangement can only be granted once the Dutch tax authorities have issued an additional assessment. We prepare that request for € 125. What catching up costs with us, you work out in the cost calculator; all our services are on services for foreign businesses.
What we do
We work out from when your company owed Dutch VAT, register it where needed (€ 275, everything included) and file each missed quarter (€ 325 per quarter). A separate correction return costs € 125. If a penalty has already been imposed, we can file a notice of objection (€ 275); the deadline is six weeks.
Frequently asked questions
What is the penalty for a late Dutch VAT return?
€ 82 for a late return, in exceptional cases € 165. For late payment 3% of the VAT, at least € 50 and at most € 6,709. Within seven days after the deadline there is normally no penalty for a late return, and none for a late payment if the previous period was paid on time.
Can we avoid a penalty if we never registered?
As a rule yes, if you correct it yourself before you know or should suspect that the Dutch tax authorities are aware of it. The VAT and any tax interest are still due.
How far back can the Dutch tax authorities go?
Five years after the end of the calendar year in which the VAT became due.
When is a Dutch VAT return late for a foreign company?
For a company without an establishment or fixed establishment in the Netherlands, after the last day of the second month after the quarter. For the third quarter of 2026 that is 30 November 2026.
Is there a penalty if a Dutch VAT return is five days late?
Normally not for the return: a return filed within seven days after the deadline gets no filing penalty. A payment five days late only stays without a penalty if the previous period was paid on time.
What happens if we do not file a Dutch VAT return at all?
The Dutch tax authorities issue an additional assessment for an estimated amount, with a filing penalty and a payment penalty. You then have to prove that the estimate is wrong.
How do we correct a Dutch VAT return that was wrong?
A correction of € 1,000 or less can go into your next return. Above that you file a separate correction return; we prepare it for € 125.
Can we object to a Dutch VAT penalty?
Yes, within six weeks. We prepare the notice of objection for € 275.
