Fiscal representation
Do you need a fiscal representative, for example for an Article 23 licence on import VAT? We refer you to a licensed partner.
Frequently asked questions
Do we need a Dutch VAT number?
Often not. If you only sell to businesses established in the Netherlands, the VAT is in most cases reverse-charged to your customer. You do need one when you owe Dutch VAT yourself, for example on sales from Dutch stock to consumers, or when you move your own goods from another EU country to the Netherlands: see do I need a Dutch VAT number?
Does stock in a Dutch warehouse make our company established in the Netherlands?
Usually not. A warehouse without staff and technical means suited to supplying customers is not a fixed establishment. Your company then registers as a foreign business; see selling from a Dutch 3PL or fulfilment warehouse.
Do we need a fiscal representative?
Usually not: most foreign companies, also from outside the EU, can register for Dutch VAT directly. A representative is compulsory only for certain distance sales by companies from outside the EU and for the VAT warehouse and excise warehouse arrangements. We are not a fiscal representative; if you need one, we refer you to a licensed partner (see fiscal representative: do you need one?).
How often do we file Dutch VAT returns?
As a rule per calendar quarter, also when there is nothing to report; monthly is possible on request. By law the return and the payment are due within one month after the end of the period; for a company without an establishment or fixed establishment in the Netherlands, the Dutch tax authorities allow two months. We file them in our monthly package.
Can we reclaim Dutch VAT without a Dutch VAT number?
Yes, if you owe no Dutch VAT yourself. Companies from another EU country file the request through the portal of their own tax authority by 30 September of the following year; companies from outside the EU file it with the Dutch tax authorities within six months after the end of the calendar year. See Dutch VAT refund.
Do we need an EORI number?
Only if your company deals with customs in the EU, for example when it imports goods from outside the EU. A company from outside the EU registers with the customs authority where it files its first declaration, and the number is valid in the whole EU. We apply for it for € 59: see a Dutch EORI number.
What does Dutch VAT compliance cost with you?
A Dutch VAT registration is € 275 one-off, everything included. After that € 100 per month for every VAT return, or € 150 per month with the OSS return, and € 25 per month extra for the EC Sales List; all amounts exclude VAT. Work out your fee with the cost calculator.
We should have registered earlier. What now?
The Dutch VAT for the past periods is still due, and the Dutch tax authorities can assess it up to five years after the end of the calendar year. If you correct it yourself before you know or should suspect that the Dutch tax authorities are aware of it, there is as a rule no penalty: see late or missed Dutch VAT returns.
